Where There’s a Will (or Living Trust), There’s a Way

The importance of current, up-to-date will or living trust cannot be overstated. And yet, various studies have shown that only 55-65% of people die with a valid will in place. Why is this? Because many people assume they do not need a will because their estate is not large enough.

Unfortunately, this assumption confuses taxation with distribution. And in absence of a valid will (or living trust), state law will determine the distribution of your assets.

Since no one can guess what another person’s wishes might have been, Colorado (like every state) has created a formula to distribute the assets for any resident that dies without a will. This formula is part of intestacy law. Although the intestacy formula guides distribution, rarely does it ever represent a person’s true wishes.

If you do not have a will, please consider creating one. It can make a huge difference for your friends and loved ones.
